Terms of sale

last updated: [À REMPLIR : date]

These terms cover what you buy on orb1tal.net: the Apsis app and the beat licences. Creem (creem.io) sells them for me as the seller of record: it takes the payment, handles the VAT and sends your receipt, under its own terms. These terms say what you get from me.

1. Who

  • The seller: Creem (creem.io), whose terms apply to the payment: [À REMPLIR : lien vers les conditions de Creem, étape 15].
  • The maker and licensor: [À REMPLIR : prénom et nom], who makes music and software as orb1tal — details on the legal notice.

2. Prices

Prices are in euros, VAT included, as shown on each page and at checkout. The price you pay is the one shown at checkout.

Buy 1, get 1 free on the beats, for as long as this page shows it:

  • Each mp3 lease or wav lease you buy comes with one more beat of your choice from the store, free, with the same licence and an agreement of its own.
  • One free beat for each of these leases bought. The other licences are not part of the offer.
  • You name the free beat when you ask for your licence, or at checkout, and it comes with your files.
  • The price of each licence is the same with or without the offer.

-50% on a kit with Apsis, for as long as this page shows it:

  • Each Apsis licence you buy comes with a code that takes 50% off one kit of your choice, at its price on the day you use it.
  • The code comes with your Apsis key and works once, on the kits as soon as they are out.
  • The price of Apsis is the same with or without the offer.

3. What you get

  • Apsis: a licence to use the app, not the app itself. It is personal, on two computers at a time (you can free one from the app), with the updates of Apsis for as long as it is offered. You may not share your key, resell it, or change or crack the app. The videos you make are yours — the music in them has to be yours, or licensed to you.
  • A beat licence: the rights written in the agreement of that licence, which comes with your files. All the licences and their agreements.

4. Delivery

  • Apsis: the download link and your licence key come by email right after the payment, and stay in your customer account at the seller.
  • A beat licence: the files the licence gives, and its agreement as a PDF, come by email from me within [À REMPLIR : délai d’envoi des fichiers, par exemple 24 hours]of the payment.

5. Your right of withdrawal

In the European Union, you normally have 14 days to withdraw from an online purchase. For digital content delivered at once, this right ends when the delivery starts, if you asked for it at checkout and acknowledged that you lose the right (French Consumer Code, article L221-28 13°). The checkout asks you both.

6. Refunds

  • Apsis: refunded within 7 days of the purchase, no questions asked — on top of your rights, not instead of them. Write from the email you bought with, with your order number. Your key then stops working.
  • A beat licence: once its files are sent, it is not refunded, except when the files are faulty and I cannot replace them, or when you were charged twice.

7. If something does not work

What you buy has to work as described (the legal guarantee of conformity for digital content, French Consumer Code, articles L224-25-12 and following). If Apsis or a file does not, write to me: I fix it, replace it, or refund you.

8. Questions and disputes

Write to contact.orbtal@gmail.com, I reply myself. French law applies, and the courts of[À REMPLIR : ville] decide, unless the law where you live gives you another choice as a consumer.
