Exclusive rights: the agreement

last updated: [À REMPLIR : date]

This is the agreement you accept when you buy the exclusive rights of a beat by orb1tal. Your order receipt completes it: it names you, the beat, this licence, the price and the date. Keep both. All the licences →

1. Who

  • The licensor: [À REMPLIR : prénom et nom], who makes music as orb1tal, [À REMPLIR : adresse], contact.orbtal@gmail.com (“I”, “me”).
  • The licensee: the person or company named on the order receipt (“you”).

2. The beat and the files

The beat is the instrumental named on your order receipt, composed and produced by me. You get the stems (one wav per sound of the beat) + wav + mp3, by email or download link once the order is paid.

The files are digital and sent as soon as the order is paid, at your request: you agreed to this before the delivery started, and gave up the 14-day right of withdrawal for digital content (French Consumer Code, article L221-28 13°). This agreement, sent with the files, confirms it.

3. What exclusive rights give you

An exclusive licence, worldwide, from the date of the order: from then on, I license the beat to no one else and take it off the store. You can record songs on it and release them without any limit: copies, streams, music videos, live shows and radio.

Licences sold before your order stay valid within their own limits: I tell you how many there are before you buy. The price is agreed for each beat and paid before the files are sent.

4. What you can do

  • Record your vocals on the beat and release the song under your name, on streaming platforms and stores.
  • Arrange the beat for your song: cut it, loop it, change its length, add your own sounds.
  • Put the song in a music video or a visualizer.
  • Perform the song live.

5. What you cannot do

  • Sell, give away or share the beat itself, alone or in a pack: only your song, with your vocals, goes out.
  • Pass the files or this licence on to someone else: it is yours only.
  • Use the beat in a beat, a loop pack or a sample pack of your own.
  • Say you made the beat, or leave the credit out.
  • Use the beat or its files to train an AI model.

6. The credit

Every release credits the beat as prod. orb1tal: in the credits on streaming platforms and stores, and in the description of each video.

7. Who owns what

I keep the copyright in the beat, its music and its recording. You own your lyrics and your vocals. When you register the song with a collecting society (SACEM or yours), list me as the composer of the music, with [À REMPLIR : part des droits d’auteur de la chanson, par exemple 50 %] of the writers' share. The recording of your song is yours, and so is the money it earns.

You may register your song with YouTube Content ID — you then release the claims made on the songs of artists who licensed the beat before your order.

8. What I guarantee

I made the beat. It contains no sample that has not been cleared.

9. If the agreement is broken

If you go over a limit without a higher licence, or break this agreement, the licence ends: the song comes down, and you keep no right to the beat.

10. The law

French law applies. If we disagree, we first try to settle it by email — then the courts of [À REMPLIR : ville] decide, unless the law gives you another choice as a consumer. Your order receipt and this page are the whole agreement.
